BATARA BARUNA LIVEABOARD
General Terms & Conditions

1. Definitions

“Vessel” refers to BATARA BARUNA Liveaboard.

“Operator” refers to the management of BATARA BARUNA.

“Client” refers to any individual, group, agent, or charterer making a booking.

“Charter” refers to private or cabin-based liveaboard services provided by BATARA BARUNA.

2. Acceptance of Terms

By making a booking, paying a deposit, or boarding the Vessel, the Client confirms that they have read,
understood, and agreed to these General Terms & Conditions. A signed copy may be required prior to departure.

3. Inclusions

  • Accommodation onboard the Vessel according to confirmed cabin allocation
  • Group expedition documentation
  • Full-board meal plan including breakfast, lunch, and dinner
  • Mineral water, coffee, and tea during the trip
  • Welcome drink
  • Guided dives and/or land excursions as per confirmed itinerary
  • Diving package with certified dive guides / divemasters
  • Scuba tanks and weights for certified divers
  • Snorkeling gear and snorkeling guide
  • Non-motorized water activities including kayaks and stand-up paddleboards (subject to availability)
  • Beach towels, cabin towels, and deck towels
  • Limited onboard Wi-Fi (connectivity not guaranteed)
  • VAT (Value Added Tax)
  • Pick-up and drop-off services from hotel or airport to the meeting point within the Labuan Bajo mainland area near the harbour

4. Exclusions

  • International or domestic flights
  • Hotel accommodation before or after the trip
  • Alcoholic beverages
  • Personal snacks
  • Gratuities for crew and trip leaders
  • Nitrox fills
  • Private dive guide
  • Rental dive equipment
  • Scuba diving courses
  • Personal travel and dive insurance
  • Underwater photography or videography services, including dedicated personal documentation beyond the shared group coverage
  • Special events or private arrangements unless pre-booked

5. Required Extras

  • Fuel surcharge (subject to route selection and fuel price fluctuations)
  • National Park & Marine Park fees (depending on destination), determined by prevailing government regulations at the time of travel
  • Drone permit for Komodo National Park: Estimated at IDR 2,100,000 per unit per day (optional and must be requested at least 7 days prior to departure)
  • Port, harbour, and local authority fees

6. Check-in & Check-out

Check-in: Between 09:00 – 12:00 on the day of departure (unless otherwise stated).

Check-out: Between 06:30 – 11:00 on the final day, subject to itinerary and port authority regulations.

7. Booking & Payment

  • A 50% non-refundable deposit is required to confirm a booking
  • The remaining 50% balance must be paid no later than 7 days prior to departure
  • Failure to complete payment may result in cancellation without refund
  • All payments must be made via bank transfer to the official BATARA BARUNA account

Book Now, Pay Later: Clients may place a provisional booking online without immediate payment.
BATARA BARUNA will temporarily hold the requested space, subject to availability.
The booking will only be confirmed once the required deposit is received within the specified timeframe.

8. Cancellation Policy

  • More than 15 days before departure: 50% of total charter fee retained (deposit), 50% refundable
  • 14 days or less before departure: 100% of total charter fee is non-refundable

In the event a Client is unable to participate after confirmation, the booking may be transferred to a replacement guest,
subject to prior notification and approval by BATARA BARUNA.

Clients who fail to arrive at the designated meeting point on time, resulting in operational disruption or itinerary changes,
shall be considered to have forfeited their participation without entitlement to any refund.

9. Itinerary & Weather Conditions

All itineraries, dive sites, and routes are subject to change. The Captain has absolute authority to modify the itinerary
for safety, weather, sea conditions, or regulatory reasons. No refunds will be issued for itinerary changes caused by
weather or force majeure.

10. Force Majeure

BATARA BARUNA shall not be liable for delays, changes, or cancellations due to force majeure events,
including but not limited to severe weather, government restrictions, natural disasters,
political instability, or mechanical and safety-related issues.

11. Insurance & Liability

All Clients must have valid travel and dive insurance. Participation in diving and marine activities
is undertaken at the Client’s own risk. BATARA BARUNA is not responsible for personal injury, illness,
or loss or damage to personal belongings.

BATARA BARUNA shall not be held responsible for flight schedule changes, airline delays,
loss or damage of baggage, hotel services, or delays caused by third-party transportation providers.

12. Damage & Loss

Clients are responsible for any damage or loss caused to the Vessel, its equipment, or rented gear.
Repair or replacement costs will be charged accordingly.

13. Participant Conduct & Responsibility

All Clients must follow the instructions and decisions of the Captain, trip leader, and crew at all times.
Unilateral decisions affecting safety, itinerary, or operations are not permitted without prior approval.

Any Client engaging in illegal drug use, disruptive behavior, or actions compromising the safety or comfort
of others may be removed or repatriated at the discretion of BATARA BARUNA, without refund.

14. Third-Party Terms

BATARA BARUNA is not responsible for the terms, conditions, or policies imposed by third-party service providers,
including airlines, hotels, port authorities, or local operators.

15. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with
the laws of the Republic of Indonesia.
